 Abstract

The article deals with the problem of achieving a balance of state power and human freedom in the activities of the constitutional justice bodies. The degree of reality of the principles proclaimed in the Constitution of the Russian Federation largely depends on the depth of its penetration into the contradictions between power and freedom. Speaking about the role of the constitutional (statutory) courts of the subjects of the Russian Federation, it should be understood that their activities in the implementation of constitutional justice cannot be reduced solely to the formal application of constitutional principles and norms. While protecting the fundamental human rights and freedoms of the citizen, the legal protection of the constituent acts of the subjects of the Russian Federation, the constitutional (statutory) courts ensure the inviolability and effectiveness of the values reflected in the constitutions (charters) of the subjects of the Russian Federation.
The author comes to the conclusion that constitutional justice is an effective legal tool for resolving conflicts in society and finding a social compromise through a dialogue of the parties on the basis of their legal equality. However, it is necessary to take into account the fact that such a dialogue is not a once and for all resolved and indisputable process. Decisions of all bodies of constitutional jus-tice have the property of finality, otherwise it would lead to the destruction of the constitutional and legal space. At the same time, the decisions of the constitutional review bodies at all levels contribute to the growth of the legal fabric and can serve as a basis for further discussion in the field of achieving social harmony and strengthening social justice.
